These Terms of Service apply to services operated by Tarik Cil (sole proprietor), doing business as Chosen Calls. Contact: tarikcil.us@gmail.com
These Terms of Service ("Terms") govern use of the Chosen Calls service ("the Service") by business customers ("Customer," "you"). By subscribing to or using the Service, you agree to these Terms.
The Service answers inbound telephone calls to a designated business phone number using an AI voice agent. It classifies callers, collects caller-provided information, answers a pre-approved set of frequently asked questions, records structured call details, and sends call notifications to recipients the Customer designates. The AI agent discloses that it is an automated assistant, does not provide legal, tax, financial, or lending advice, and does not answer questions outside its approved list. The Service takes messages and arranges callbacks; it does not transfer live calls.
The Customer is responsible for the accuracy of its configuration — including its business information, notification recipients, approved FAQ answers, and greeting — and for keeping its account credentials confidential. The Customer confirms it has the right to route its business phone number to the Service.
The Service is provided on a subscription basis. Fees, included usage (such as call minutes), and any add-ons are those stated in the Customer's order or plan at the time of purchase. Fees are billed in advance and are non-refundable except where required by law. We may change pricing with notice effective at the next renewal. Either party may choose not to renew.
The Customer must not use the Service: for any unlawful purpose; to collect information from callers deceptively; to send or cause unsolicited marketing messages; in violation of telephone-consumer protection, telemarketing, or anti-spam laws applicable to the Customer's business; or in any manner that interferes with the operation or security of the Service. The Service is not designed for and must not be relied upon for emergency calls or time-critical safety communications.
As between the parties, the Customer owns the caller and lead information collected on its behalf. We process it only to provide the Service, as described in the Privacy Policy. The Customer is responsible for its own legal obligations toward its callers and clients, including any notice or consent obligations that apply to its use of an automated answering service in its jurisdiction.
We may improve or modify the Service, provided the changes do not materially reduce its core functionality during a paid term. The Service depends on third-party providers (telephony, voice AI, hosting); we do not guarantee uninterrupted or error-free operation.
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated responses may contain errors; the Service is a message-taking and lead-intake tool, not a substitute for the Customer's professional judgment.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the Service is limited to the fees the Customer paid for the Service in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
Either party may terminate for material breach that remains uncured fifteen (15) days after written notice. We may suspend the Service immediately for a violation of Section 4 or to prevent harm to the Service or third parties. Upon termination, the Customer's call data is deleted in accordance with the retention schedule in the Privacy Policy, and any data-export request must be made before the end of that period.
These Terms are the entire agreement between the parties regarding the Service and supersede prior discussions. If any provision is found unenforceable, the remainder stays in effect. These Terms are governed by the laws of the United States and the state of the Service operator's principal place of business, without regard to conflicts of law rules. Changes to these Terms will be posted at this address and take effect at the Customer's next renewal.
